How this is calculated
The rule
Article 19 of Federal Decree-Law No. 33 of 2021: overtime beyond the normal hours (Article 17: 8 hours a day or 48 a week) is paid at the wage for normal hours worked out on the basic wage, plus not less than 25%. Overtime between 10 pm and 4 am is paid with an increase of not less than 50%, and shift workers are excluded from that clause. Work on the weekend day set in the contract is compensated with another day off, or paid at the wage of that day plus not less than 50% of the basic wage for that day.
Convention used
The hourly wage is the monthly basic wage divided by 30 and by 8. The Decree-Law text read does not give that divisor. The weekend day is paid as the day's wage (basic divided by 30) plus 50%. Each line is rounded to the fil.
Limits
Overtime may not exceed 2 hours a day, and total hours may not exceed 144 in 3 weeks, except as the Executive Regulation allows. A worker may not be instructed to work more than two consecutive weekend days, except day workers (Article 19(5)).
