How this is calculated
The rule
Fair Work Act 2009 s 90(2): when employment ends the employer must pay the amount the employee would have been paid had they taken the accrued, unused annual leave. Employees accrue 4 weeks a year, or 5 for some shiftworkers (s 87).
The calculation
Hours times the base hourly rate, rounded to the cent. If you enter a leave loading percentage, it is applied to that amount and rounded to the cent again.
Leave loading
Annual leave loading is not part of the NES. It is set by an award or enterprise agreement, so the percentage is yours to enter. Some awards set it at 17.5%. The Fair Work Ombudsman says it is included in the final payment if it would have been paid when taking leave during employment.
Not included
Tax withheld from the payment, long service leave, leave cashed out under an agreement, and any extra terms in your contract or award.
